Terms of Service
This page sets out the agreement plainly, so you can see at a glance what we undertake to do and what is asked of you at each stage.
Site use
Using the site means you accept these terms. Access is granted on the condition that the site is used lawfully, and not in a way that degrades it for other customers.
Where fraud or persistent misuse comes to light, access may be suspended and orders placed by automated means may be cancelled.
The site is provided on an as-available basis, and maintenance or security work may require part of it to be withdrawn for a period.
Where such work affects an order you have already placed, we will contact you rather than leaving you to discover it.
Nothing unlawful, abusive or misleading may be submitted through the site, and credentials issued to you must be kept confidential.

Orders
An order is an offer to buy, and a contract forms only when we confirm dispatch. We may decline an order if an item sells out, if payment cannot be verified, if the address is incomplete, or if fraud is suspected.
Where we cancel after payment has been taken, the full amount is refunded and a reason is given. If something shown as available proves not to be, you are told before payment rather than after.
Stock is limited and ranges change through the year, which makes the product page the only dependable guide to what is available.

Price and payment
Prices are shown in US dollars and may change without notice, but the price confirmed on your order email applies to that order. Sales tax is calculated at checkout from the delivery address.
Payment is taken on the processor's hosted page, and full card numbers are never stored by us. No surcharge is applied for any particular method.
Where a promotion applies, the discounted figure is shown before you confirm and is the one used if a refund later becomes due.
We add no handling fee and no surcharge, and any international transaction fee is set by your bank rather than by us.

Delivery
Delivery dates are estimates rather than guarantees, and we are not responsible for delays caused by the carrier, severe weather, an incomplete address or a parcel nobody collects.
Risk passes to you on delivery, but where a parcel is lost or damaged in transit we pursue the carrier and offer a replacement or refund once the claim is settled.
Where the carrier offers a delivery window or a collection point, that arrangement sits between you and the carrier once the parcel is in their network.
If a delivery is needed for a fixed date, ask us before ordering and we will say honestly whether the timing is realistic.
A parcel cannot be redirected after dispatch, and the carrier will not accept a change of destination from us once the label has been scanned.

Returns and refunds
An unused item may be returned within 30 days of delivery under the Return Policy, which forms part of these terms. Refunds are issued within seven calendar days of inspection.
If the Return Policy and these terms appear to say different things about a return, the Return Policy is the wording that decides the point.
A parcel is your responsibility on the way back, so a tracked service is worth using whenever the goods are worth more than the postage.
If the card used for the purchase has since been cancelled, tell us once the bank has confirmed the position and another route for the refund will be arranged.
Refunds cannot be sent to a different card, a different account or in cash, because the reversal must follow the original transaction.
Keep the tracking reference until the refund has been confirmed, since it is the quickest way to trace a parcel that goes missing.

Care and safety
Care instructions published on the product page, and on any label supplied with the item, form part of what the item is sold on.
Garden tools should be used for the job they were made for, and cutting edges kept sharp rather than forced through material. Clean and dry tools after use, oil the metal before winter storage, and check handles and fixings for splits or looseness.
Following that guidance is what keeps the item working as described, and it is also the standard used when a return is assessed.
If an item arrives with no instructions, or with guidance that clearly belongs to something else, ask us before putting it to use.
Damage arising from misuse, from disregarding the care instructions, or from altering an item is not covered by the Return Policy.
Where an item is supplied with a manufacturer's warranty, that warranty runs alongside these terms.

Intellectual property
The text, photography, graphics, page layout and the Porchline Patio name are owned by us or used under licence, and may not be reproduced without written permission.
Linking to a product page and quoting a short extract in a review is welcome, and images are usually supplied for editorial use on request.
Names and marks that belong to someone else stay with their owner, and visiting the site does not confer any right to reuse them.
Editorial use of our product photography is normally allowed on request, as long as the image is reproduced in full and the shop is named as the source.
Using our name, logo or photography in a way that suggests endorsement of another business is not permitted.

Conduct
Reviews, enquiries and messages must be honest and lawful, an account may only be opened in your own name, and nothing may be uploaded that damages the site or interferes with other people's use of it.
From time to time an order may be held for a routine verification step; it is released as soon as the details tally with the record.
An account can be paused while a suspected breach is looked into, and the customer is told why the pause was applied.
Ordering goods with no intention of paying, or using the returns process as a borrowing arrangement, is equally prohibited.
A payment reversed without any contact first may mean a different payment method is required on later orders until the matter is settled.

Liability
To the extent permitted by law we are not liable for indirect or consequential loss arising from the use of the site or from the purchase of a product.
Liability for any claim relating to an order is limited to the amount paid for that order, and nothing here excludes responsibility for death or personal injury caused by negligence, or for fraud.
Where a product causes damage to property, the position depends on whether it was used as intended and on the terms of any manufacturer warranty.
This section is not meant to put anyone off raising a real problem, and the time allowed for bringing a claim is left exactly as the law provides.

Changes
These terms may be amended to reflect changes in the business or in the law, and the version on this page is the one that applies.
Amendments are not applied retrospectively to orders already placed, and any revision that materially cuts back your rights is flagged at the top of the page.
A change forced by legislation applies from the date the statute requires, which may be earlier or later than the day the page was updated.
We keep earlier versions on file, and can tell you which version applied to a particular order.
Continuing to use the site after a revision means you accept the revised terms.
An order keeps the terms that were in force on the day it was placed.

Governing law
These terms are governed by the law of the United States and of the state in which our registered office is located, disregarding conflict-of-law rules.
Before any formal step, write to us with the order reference and a description of the problem, since most disagreements are resolved at that stage.
The governing law does not remove protections available under the consumer law of your own state or country, which apply alongside it.
If correspondence does not settle the matter, both parties agree to put the dispute to a neutral mediator before either side begins court proceedings.
A short written summary of the problem, sent before anything formal begins, is usually all that is needed.
